Minister of Civil Aviation Exempts Airlines from Certain Fees
On 24 February 2013, the Minister of Civil Aviation issued decision No. 142 of 2013 allowing, in some cases, the exemption of some airlines and other bodies from all or part of the service, occupancy, and utilization fees stipulated in Articles 16, 21, and 22 of the Law regulating fees for Civil Aviation Services (the “Decision”).[1] This Decision came in execution of a recommendation issued by the Supreme Council of Services Pricing dated 14 February 2013 renewing the Civil Aviation Authority’s authorization in approving this exemption. This requires referring to the above-mentioned Articles concerned with service, occupancy, and utilization fees to determine the effectiveness of the Decision. Law No 93 of 2003 (the “Law”),[2] exempts some airlines from the service fees stipulated in Article 16 of the Law. This covers services provided while passing through Egyptian airspace or in cases of landing, take-off, waiting or harbouring of any planes in any Egyptian airport. Article 16 shall apply to both cargo and passenger services and to any other cases determined by the Minister of Civil Aviation. Articles 21 and 22 of the same Law deal with the occupancy and utilization fees of any part of Egyptian airport buildings, lands, equipment and devices. The Articles state the obligation to price these services based on the Minister’s Decision after consulting the Supreme Council of Services Pricing. The Decision has determined four cases in which some of the airlines can be exempted from these fees: new airlines at the start of activity, emergencies, requirements of public interest, and finally cases of reciprocity.
