Prime Minister Issues New Rules for Public Procurement Announcements: Electronic Publishing of Announcements is Now Mandatory

On January 5th, 2010, Prime Minister Decision Number 33 of 2010 was published in the Egyptian Gazette, mandating the publication of all announcements concerning public procurement made by ministries, public authorities and other organs of the State on the official Government Portal (www.etenders.gov.eg) as of January 1st, 2010. This is required without prejudice to other means of publication of announcements stated in the Public Procurement Law Number 89 of 1998. In other words, this is an additional method of public announcement that should provide easier and more transparent access to information pertaining to public procurement. There are, however, certain exemptions from the mandatory electronic publication with respect to announcements and calls for tender made by the ministries of defense, military production and the national security agency. Furthermore, other exemptions made by made by the General Authority for Governmental Services – part of the Ministry of Finance – depending on the case. The Decree is a helpful addition to the efforts by the Government to improve the transparency and fairness of access to public procurement.

صدر قرار رئيس مجلس الوزراء رقم 33 لسنة 2010 وتم نشره في الوقائع المصرية بتاريخ 5 يناير 2010، بإلزام وحدات الجهاز الإداري للدولة بما فيها من وزارات ومصالح وأجهزة وهيئات عامة بنشر كراسات الشروط والمواصفات الخاصة بالمناقصات والممارسات العامة والمحدودة والمحلية على بوابة المشتريات الحكومية (www.etenders.gov.eg) بدءا من الأول من يناير 2010. وتجدر ملاحظة أن النشر الإلكتروني المطلوب بموجب القرار الجديد لا يتعارض ولا يحل محل أساليب النشر المنصوص عليها في قانون المناقصات والمزايدات الصادر بالقانون رقم 89 لسنة 1998، وبالتالي فهو وسيلة إضافية لتحسين وسائل العلم بتلك الإعلانات. ومع ذلك فقد نص القرار على بعض الاستثناءات، وهي الإعلانات الصادرة عن وزارة الدفاع والإنتاج الحربي، ووزارة الدولة للإنتاج الحربي، وهيئة الأمن القومي، وكذلك ما توافق الهيئة العامة للخدمات الحكومية – التابعة لوزارة المالية – على استثنائه من النشر الإلكتروني. والقرار الجديد يعتبر خطوة إيجابية نحو تحسين الشفافية في مجال المناقصات الحكومية والعمل على جعل المناقصات والممارسات قدر الإمكان معروفة لكل من يرغب في التقدم لها.
