A Ban on the Establishment of Tourism Companies is Renewed for One More Year

On 14 February 2017, the Minister of Tourism issued a decision renewing the ban on the establishment of companies working in all fields of tourism (the “Decision”).[1] The Decision states as a rationale for the ban that “the country does not need them”. This is a renewal of a previous identical decision issued on 29 February 2016[2] – which had banned the establishment of tourism companies for the previous year. Despite the rationale stated in the Decision, and the recession suffered by the tourism sector in Egypt, this is not the right way to protect such industry. Rather, this measure deprives the market from new investors who may have the capacity and willingness to open new markets, use innovative technologies, or rely on original marketing ideas. Such ban deprives the market from innovation and competition. In our opinion it would be more beneficial to allow the establishment of new companies, subject to the criteria, conditions, and guarantees already applied, in order to introduce some dynamism into this promising sector. بتاريخ 14 فبراير 2017 أصدر وزير السياحة قراراً بشأن تجديد العمل بوقف إنشاء شركات جديدة تعمل في كافة مجالات السياحة ("القرار").[1] وقد نص القرار على أن السبب في ذلك هو "عدم حاجة البلاد إليها". ويأتي هذا القرار تجديدا لقرار سابق عليه – صادر في 28 فبراير 2016[2] – والذي كان قد أوقف بدوره تأسيس شركات سياحية لمدة عام سابق.

وبرغم التبرير الوارد في القرار، وما تعاني منه بالفعل السوق السياحية من ركود خلال السنوات الأخيرة، إلا أن وضع القيود على تأسيس شركات جديدة ليس الوسيلة المثلي لحماية صناعة السياحة المصرية لأنها تحرم السوق من مستثمرين جدد قد يكون لديهم القدرة والرغبة في فتح أسواق جديدة أو استخدام تقنيات مستحدثة أو الاعتماد على وسائل مبتكرة للتسويق، بما يحرم السوق من المنافسة والتجديد. وفي تقديرنا أن إطلاق حرية تأسيس الشركات السياحية، وفقا للمعايير والضوابط والضمانات المعمول بها، قد يكون الوسيلة الأفضل لتحريك وتشجيع نمو هذا القطاع الواعد.
